General terms and conditions of business
in the context of purchase contracts concluded between

and the customer (as specified in the respective purchase contract),
hereinafter referred to as "Customer" ,

1 Conclusion of contract
The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding online catalog. You can initially place our products in your shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction tools provided and explained during the ordering process. By clicking the "Buy now" button, you place a binding order for the goods contained in the shopping cart, which will be confirmed immediately by email. This confirmation of receipt does not constitute a binding acceptance of the order. The contract language is German.
1.1 Subscription systems
Special conditions for subscription products
(1) For selected products, ANS Nutrivity Secrets offers a subscription model with a minimum term of 12 months . During this term, automatic monthly deliveries will be made to the delivery address specified during the order. The term begins with the dispatch of the first delivery.
(2) The objective of this model is to ensure a continuous supply of high-quality nutritional supplements. In order to meet individual seasonal requirements and current scientific findings, ANS Nutrivity Secrets reserves the right to change the composition or selection of the products delivered monthly as part of the subscription , particularly depending on availability, season, climatic conditions, and health needs.
(3) After the twelve-month minimum term, the subscription will automatically renew indefinitely and can be canceled monthly at any time . Notice of cancellation must be in writing (e.g., by email) and sent to:

(4) Early termination during the minimum term is not possible. ANS Nutrivity Secrets reserves the right to terminate the subscription early for good cause, e.g., in the event of late payment or misuse of the system.
2 Order / Delivery
The essential characteristics of the ordered goods can be found in the respective product descriptions.
Goods are shipped at the seller's risk via the German parcel service DHL. Within Germany, delivery is usually within 24 hours, but in rare cases, up to a maximum of 2-3 business days after receipt of the order. Goods are normally delivered within five business days.
If this delivery time cannot be met due to unexpected demand or delays at the provider's sub-supplier, the customer will be informed. In this case, the customer has the right to withdraw from the contract.
Deliveries are insured for the provider against transport damage. Please check the integrity and completeness of the shipment upon delivery and have any damage certified. If you have any complaints, please contact us directly at +49 (0) 1512 3551129 or by email at info@ans.international.
Delivery delays caused by legal or official regulations (e.g., import or export restrictions, strikes, force majeure) and for which the supplier is not responsible shall extend the delivery period in accordance with the duration of such impediments. The buyer will be notified of their start and end dates without delay.
3 Prices / Shipping costs
The product prices shown in the provider's online shop are binding; they include the statutory VAT rate.
Within Germany, we charge a flat shipping fee of €4.90 including VAT. This fee is waived for orders over €50.00.
This does not apply to contracts concluded within other European countries and Switzerland.

In case of cancellation (see point 5 of the General Terms and Conditions), the buyer must bear the regular costs of return.
4 payment options
Our invoices are payable via PayPal or credit card.
PayPal
is an online payment service that allows you to pay securely, easily, quickly, and free of charge in many online shops. When paying via PayPal, the customer is redirected to the external website of PayPal (Europe) S.à rl et Cie, SCA upon completing the order and clicking the "buy now" button, where the payment is processed. For this purpose, it may be necessary to open an account with this payment provider. The execution of payments may depend on whether PayPal (Europe) S.à rl et Cie, SCA enters into a contractual relationship with the customer. Delays may occur due to customer verification. Otherwise, payment is made directly, i.e., before delivery. Further information can be found on the PayPal website and their terms and conditions. Separate payment terms apply to the provider's trading partners (industry, wholesalers, pharmacies, and other companies registered in the commercial register after verification). In this case, payment is also possible on account or by direct debit.
Reminder fees
Reminder fees charged for late payment correspond to the postage costs incurred for the first and second reminders. If a direct debit is returned due to incorrect bank details or insufficient funds, the provider is entitled to charge the customer for the resulting costs.
5 Cancellation policy
Right of withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason.
The cancellation period shall be fourteen days from the day on which you or a third party other than the carrier designated by you takes possession of the (last) goods or the last partial shipment or the last piece.

by means of a clear statement (e.g., a letter sent by post, fax, or email) of your decision to withdraw from this contract. You can use the sample withdrawal form ( click here) , which you can download or find enclosed. However, the use of this form is not mandatory.
Consequences of revocation
If you cancel this contract, we will refund all payments that we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a delivery method other than the cheapest standard delivery offered by us), promptly and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract. For this refund, we will use the same means of payment that you used for the original transaction, unless something else was expressly agreed with you; under no circumstances will you be charged any fees for this refund. We may refuse to refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.
You must return or hand over the goods immediately and in any event no later than fourteen days from the date on which you notify us of the cancellation of this contract to

to return or hand over the goods. This deadline is met if you send the goods before the expiry of the fourteen-day period. You will bear the direct cost of returning the goods. You only have to pay for any loss of value of the goods if this loss of value is due to handling of the goods which is not necessary to check their quality, properties and functioning. Unless the parties have agreed otherwise, the right of withdrawal does not apply, among other things, to contracts for the delivery of sealed goods which are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery.
6 Retention of title
The delivered goods remain the property of the provider until the purchase price has been paid in full.
7 Warranty
The statutory warranty rules apply.
8 Liability
The provider is liable for any breach of essential contractual obligations caused by the provider or its vicarious agents. A material contractual obligation is an obligation the fulfillment of which is essential for the proper execution of the contract and on whose compliance the customer can regularly rely. Otherwise, the provider is only liable, regardless of the legal grounds, if the provider or its vicarious agents are guilty of intent or gross negligence. To the extent that the provider is liable for slight negligence, liability is limited to such typically foreseeable damages that were reasonably foreseeable for the provider at the time the contract was concluded. The above limitations of liability, which apply to contractual and non-contractual claims, do not affect liability for delay, for claims under the Product Liability Act, producer liability, other mandatory statutory provisions, or to the extent that liability relates to damages resulting from injury to life, limb, or health.
To the extent that the provider’s liability is excluded or limited, this also applies to the benefit of its representatives, executives and vicarious agents.

10 Customer password
If the customer has created a customer account, the password must be kept secret and access to the account carefully secured. The customer must inform the provider immediately if they become aware of any misuse of their access by third parties.
11 General obligation to provide information according to Section 36 of the Consumer Dispute Settlement Act (VSBG)
The European Commission provides a platform for online dispute resolution (ODR), which gives consumers the opportunity to resolve disputes related to their online orders without initially involving a court.
We do not participate in an alternative dispute resolution system as defined by EU Regulation No. 524/2013, but you are welcome to contact our customer service. You can reach us for all matters at info@anusan.de.

Final provisions
If the customer is a merchant, a legal entity under public law, or a special fund under public law, the place of jurisdiction for all disputes arising from contractual relationships between the customer and the provider is the provider's registered office. The provider also has the right to sue at the customer's registered office.
The provider does not save the contract text, but saves the order data in summarized form and sends the order data and our General Terms and Conditions to the customer by email. You can also access the General Terms and Conditions here at any time. The above terms and conditions apply exclusively to the contractual relationship. The provider does not recognize any deviating terms and conditions of the customer unless the provider has expressly agreed to their validity in writing.
